Thank you for choosing Magnolia Atelier for your nail care needs. Please read the following terms and conditions carefully before using our website for booking.

By using our website for booking you are choosing to agree to be bound by the following terms and conditions. If you are unable to agree to our terms and conditions please come see us in person so we may further assist you.

• Appointments: We recommend that you book your service in advance so we may have extra time to make sure you have the best experience in our salon. We kindly ask that you confirm your appointments prior to your arrival.
• Cancellations: We require at least 24 hours notice to cancel or reschedule an appointment. Cancellations made after the 24 hour period will be subject to a cancellation fee. ALL deposits are non-refundable
• Prices: Please note that prices are subjected to change without notice.
• Payment: Payment is due at time of service. We accept cash, debit, credit cards and provide a tap payment system. 
• Limitation of liability: We are not liable for any damages, including, but not limited to direct, indirect, incidental, consequential, or punitive damages, arising out of or in connection with the use of our website and services. 
• Animal Policy: As much as we love animals we ask that you leave them at home that way we can ensure a safe and sanitary environment for everyone.
• Service Policy:  Magnolia Atelier reserves the right to refuse service at our discretion. Under no circumstances do we allow bullying, harassing, hate speech, or crude behavior to be tolerated. Any behavior that violates our code of conduct, or poses danger to our staff and customers will be denied service and we ask that you leave the premises immediately. 

Disclaimer: All of our services are guaranteed for 24 hours and anything outside of the 24 hour window is subjected to fall under a nail repair that will gladly be serviced by our team with proof of service date. 

1) Acceptance of Terms

By accessing or using magnoliaatelier.com (the “Site”), booking services, submitting forms, or otherwise interacting with Magnolia Atelier (“MA,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Site.

2) User Conduct & Restrictions

You agree to use the Site only for lawful purposes and in accordance with these Terms. You will not:

• Violate any applicable law or regulation;
• Upload, post, email, or transmit any content that is unlawful, defamatory, harassing, hateful, pornographic, harmful, or otherwise objectionable;
• Impersonate any person or entity, or misrepresent your affiliation with a person or entity;
• Scrape, crawl, or use automated means to access the Site (except for legitimate search engines indexing publicly available pages);
• Interfere with the security or proper functioning of the Site, including introducing viruses, malware, or harmful code;
• Use the Site to send unsolicited messages (“spam”) or to infringe on intellectual property rights;
• Attempt to gain unauthorized access to any systems, networks, user accounts, or data.

We may investigate and take any available legal action for violations.

3) Intellectual Property

All content on the Site—including text, logos, images, graphics, videos, icons, page layouts, and design elements—is owned by MA or our licensors and is protected by intellectual property laws.

• Personal Use License: We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for personal, non-commercial use only.
• Restrictions: You may not copy, modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or sell any content without our prior written consent.
• Trademarks: “Magnolia Atelier,” our logos, pictures, and any related marks are trademarks of MA. You may not use them without our prior written permission.

4) Disclaimers of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected. Any reliance on the Site is at your own risk.

5) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MA AND ITS OWNERS, EMPLOYEES, AGENTS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE—EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATING TO THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID (IF ANY) TO US FOR THE SERVICE GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.

6) User-Generated Content

If the Site allows you to post, upload, or submit content (e.g., reviews, comments, photos):

• Your Responsibility: You represent that you own or have the necessary rights to your content and that it does not violate any law or rights of others.
• License to MA: You grant MA a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, publish, translate, distribute, display, and perform your content in connection with operating, marketing, and improving the Site and our services.
• Moderation: We may remove or refuse to display any content at our sole discretion.

7) Indemnification

You agree to defend, indemnify, and hold harmless MA and our owners, employees, agents, and contractors from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your use or misuse of the Site, (b) your violation of these Terms, or (c) your violation of any third-party rights.

8) Termination & Suspension

We may, at any time and without notice, suspend or terminate your access to the Site for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Site will immediately cease.

9) Updates to Terms

We may revise these Terms from time to time by posting an updated version on the Site and updating the “Last Updated” date above. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

10) Governing Law; Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of state and federal courts located in Tarrant County, Texas for any dispute arising out of or relating to these Terms or the Site.
